PUBLIC NOTICE and OPPORTUNITY FOR COMMENT Cass County proposes to realign County State Aid Highway (CSAH) 70 from East Gull Lake Drive to County Road (R) 105. The project also includes construction of a bridge over Gull River, lighting improvements, storm pond construction, and a roundabout at the new CSAH 70 intersection with CR 105. An American Disabilities Act (ADA) compliant multi-use path will be constructed along the east side of CSAH 70 from East Gull Lake Drive to County Road (CR) 105. In accordance with Section 6009 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) Public Law 109- 59, enacted August 10, 2005, Cass County is soliciting comments on the effects this project would have on Gull Lake Recreation Area. The project will impact Gull Lake Recreation Area by acquiring right of way for the realigned CSAH 70. The project will have no negative effects on the function and use of Gull Lake Recreation Area. The City of East Gull Lake has expressed its support of this project. It is anticipated that Cass County will request the Federal Highway Administration (FHWA) to determine that the proposed action at Gull Lake Recreation Area is a Section 4(f) de minimis action in accordance with Section 6009(a) of SAFETEA-LU. A de minimis finding may be made when uses of Section 4(f) land will have no adverse effect on the protected resource.
